This Terms of Use document outlines the user policy for Vartanix, detailing the services and liabilities involved in using our products and services. By registering for any of our services, you acknowledge that you have read and accepted all the terms and conditions stated herein.
Filing a Complaint
If you are dissatisfied with any of our services and wish to file a complaint, Vartanix will strive to reach a mutually acceptable resolution. If a satisfactory solution cannot be achieved, revocation may occur. Please contact us before filing a formal complaint to seek resolution directly. The process for filing a complaint is as follows:
- Initial Contact: Reach out to our customer service team via email or phone with details of your complaint.
- Review: Our team will review your complaint within five business days.
- Resolution Proposal: We will propose a resolution. If you agree, we will implement the solution promptly.
- Escalation: If you are not satisfied with the proposed resolution, you may escalate the complaint to senior management.
Revocation
If a satisfactory solution cannot be achieved, revocation may occur. This means terminating the agreement and potentially issuing a refund, as outlined in our refund policy. Please contact us before filing a formal complaint to seek resolution directly.
Eligibility for Refund
We handle every project professionally to ensure that clients receive the agreed-upon deliverables as per the proposal terms and conditions. If a dispute arises and goes through the resolution process, refund claims will be evaluated based on the following criteria related to each service.
Application Programming
- Full Refund: A full refund will be offered if the project has not been initiated.
- No Formal Agreement: If no formal agreement or Terms of Use have been established, a partial refund may be issued at the discretion of Vartanix if the project is not completed as outlined in the delivery policy and contract. The refund will be based on the proportion of the project completed.
- Proportional Refund: The proportion of the project completed will be calculated by Vartanix, and the incomplete portion will be refunded accordingly.
Dedicated Hiring
- A full refund will be provided if there is a delay in starting the project by the assigned resource (e.g., programmer, designer, content writer, SEO expert).
- A proportionate refund will be offered if the client cancels the project at any time.
- No refund will be issued for days already worked. Clients dissatisfied with the work must immediately notify the Project Manager and request discounts for any unfinished work. No negotiations will be accepted at a later date.
Applicability of the Delivery Policy
Timely Payments
A project is not considered void if the agreed payments are not cleared on time. The client is responsible for ensuring timely payment to avoid delays in project completion.
Timely Communication from the Client
Vartanix is not bound by the Terms of Use if the client does not provide timely information necessary for project completion. Vartanix will not be responsible for delays or failures arising from miscommunication or lack of communication.
Completeness of Information Provided by the Client
Vartanix is not obligated to honor delivery or refund commitments if the client fails to provide complete project information at the project’s initiation. Compensation for delivery delays will only be provided unless a special agreement with a penalty clause for delays is in place.
Limitation of Liability
Vartanix’s liability is limited to the value of the incomplete portion of the project as per Vartanix’s proposal. Vartanix will not be held responsible for any losses resulting from the services delivered or not delivered, or for delays in service. Vartanix is only liable for a refund if the client cancels the project and communicates the cancellation in writing. Losses and Damages
- Indirect Damages: Vartanix will not be liable for indirect, incidental, or consequential damages arising from the use of our services.
- Direct Damages: Our liability for direct damages is limited to the amount paid by the client for the specific service in question.
Processing of Refunds
Refunds will be processed and issued within 5 business days of the cancellation date. Refunds will be made using the same payment method as the original transaction (e.g., check or credit card refund).
By using Vartanix’s services, you agree to adhere to these Terms of Use, ensuring a clear understanding of our policies and procedures for service provision and dispute resolution.
Refund Procedure
- Cancellation Notice: The client must provide a written notice of cancellation.
- Review and Approval: Vartanix will review the cancellation request and determine the eligibility for a refund based on the criteria outlined above.
- Processing: Once approved, the refund will be processed, and the client will be notified of the refund issuance.
